General terms and conditions of Sanacute AG
SCOPE OF APPLICATION / GENERAL
SANACUTE AG, Rothusstrasse 7, 6331 Hünenberg (hereinafter referred to as SANACUTE), based in Hünenberg/ZG, operates an online store.
The offer is aimed at private individuals of legal age and legal entities domiciled in Switzerland and the Principality of Liechtenstein. The delivery area is limited to the territories of Switzerland and the Principality of Liechtenstein.
These GTC govern all procedures of the purchasing process that take place via the online store, in particular the registration and storage of customer data, ordering, delivery, payment, customer service, complaints and the use of customer data.
The use of customer data is regulated in the privacy policy. Express reference is made to the Privacy Policy, which is an integral part of these GTC.
REGISTRATION
Registration with the online store is reserved exclusively for persons with legal capacity. In order to place an order in the online store, the customer must identify himself in the online store with his e-mail address and password.
If the customer is ordering from the online store for the first time and does not yet have an online account, they will be asked to set up a user account and enter the necessary customer data when placing their first order. The data required for registration must be provided completely and truthfully by the customer. The customer is responsible for updating their own data. Registration is free of charge. There is no entitlement to admission to the online store.
Following registration, a voucher for a first order can be sent by e-mail. This voucher can only be redeemed once per household, even in the case of multiple registrations. SANACUTE reserves the right not to accept the welcome voucher or to cancel the order in the event of repeated redemption.
The customer undertakes to protect access to his user account and not to disclose the password used for access to third parties.
An infomail with the latest news or special promotions can be sent several times a year to the e-mail address provided during registration. The customer can unsubscribe from this info mail at any time by clicking on the corresponding link in the footer at the bottom of the e-mail.
Mail may be sent to the postal address several times a year. The customer can prevent this mailing at any time by writing to customer service.
ORDERING
How can I order?
Orders in the online store can only be placed online.
Product range and product information
The product range in the online store may differ from the range offered by SANACUTE through third parties in the local sales outlets.
SANACUTE makes every effort to ensure that the product information is correct. The product information published in the online store is updated regularly and with the utmost care. In exceptional cases, this information may differ from the information actually printed on the packaging. In this case, the information on the packaging is always authoritative. The customer is in any case obliged to read specific information on allergies, intolerances, diabetes, etc. on the product packaging before consumption.
Intellectual property
All product descriptions, images, photos, texts, etc. are the sole property of SANACUTE.
Quantity restriction
In order to ensure that the products are available to all customers as fully as possible, SANACUTE reserves the right to limit quantities to normal household quantities. In this case, only a certain number of products can be placed in the shopping cart per product or product category.
Order placement / Conclusion of contract
The order is binding for the customer when he/she completes the online order process by clicking on the "Send order" confirmation button. After clicking on the confirmation button, the customer can no longer change the content of the order. By clicking on the confirmation button, the customer confirms the accuracy of all the information provided. By clicking on the confirmation button, the customer submits a binding offer to purchase the ordered products. Immediately after completing the order process, the customer receives an e-mail confirming receipt of the order. This confirmation e-mail from SANACUTE represents the acceptance of the offer by SANACUTE. A contract between the customer and SANACUTE is only concluded with this confirmation e-mail from SANACUTE.
The Customer has no claim to acceptance of its offer by SANACUTE. SANACUTE is free not to accept an order and to refuse to confirm it.
Orders can be placed up to a maximum of x days before the desired delivery date. Delivery is carried out by third parties. It is therefore not possible to determine or reserve a delivery window.
Modification and cancellation of orders
Orders can only be changed as long as the customer has not yet completed the order process by clicking the "Submit order" confirmation button. Once the customer has clicked on the confirmation button and thus submitted his offer to SANACUTE, it is no longer possible to change the order.
The customer can cancel orders confirmed by SANACUTE if the cancellation is made at least xx hours before the selected delivery date. The xx hours must be entirely in working days. Example: If the customer orders in the online store on Friday and requests delivery on the following Monday, the order can no longer be canceled because the cancellation period of xx hours falls within the weekend.
To cancel the order, the customer must contact customer service. Customer service can be contacted as follows: Contact form. Cancellation is only valid if confirmed by Customer Service. SANACUTE reserves the right to cancel orders. In this case, the customer will be informed by e-mail before the goods are delivered.
Guarantee of data communication
According to the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or uninterrupted at all times. SANACUTE is therefore not liable for the constant and uninterrupted availability of the online store or for technical and electronic errors during ordering processes, in particular not for the delayed processing or acceptance of orders.
DELIVERY
Delivery of ordered products
The ordered products will be delivered to the delivery address provided by the customer at the selected delivery time.
Delivery can be made by various delivery service partners.
In the case of delivery by a delivery service partner, the delivery is deposited at the delivery address in the absence of the customer or the contact person specified by the customer, usually in front of the front door. By completing the order process in the online store, the customer consents to the delivery being left at the delivery address if the customer is absent.
Deliveries by delivery service partners to addresses without home delivery are deposited at the location where the parcel service deposits parcels for such addresses.
When the order is handed over or the products are deposited, the benefits and risks, in particular the risk of theft, damage by third parties and environmental influences, are transferred to the customer.
Delivery times and compliance with delivery deadlines
SANACUTE and the delivery service partners shall make every effort to meet the delivery deadlines. However, all delivery times stated by SANACUTE are for guidance only. Non-compliance with delivery times by SANACUTE and its delivery service partners does not entitle the customer to withdraw from the contract or claim damages.
Impossibility of delivery
In the event that SANACUTE's delivery service partners are unable to deliver an order confirmed by SANACUTE, SANACUTE is under no obligation to carry out the delivery elsewhere. In this case, the order will be canceled by SANACUTE. The customer will be informed by e-mail.
The customer shall not be entitled to any compensation as a result.
The customer is obliged to provide truthful information and to comply with the information provided. If the Customer fails to do so and SANACUTE's delivery service partner is therefore unable to deliver the order, e.g. due to incorrect address details provided by the Customer or if the Customer does not wish to have the goods delivered by SANACUTE's own delivery service and is nevertheless not at home, SANACUTE shall be entitled to cancel the order and to demand a flat-rate compensation of CHF 50.00.
Incomplete fulfillment of the order
SANACUTE endeavors to deliver all ordered products in the ordered quantity and in high quality. In exceptional cases, however, it may happen that for various reasons not enough products are available or cannot be released for delivery. SANACUTE therefore reserves the right to make partial deliveries. In this case, the customer will be informed by e-mail before the goods are delivered.
Products that are not available at the time of delivery will neither be forwarded nor replaced by other products. The products actually delivered will be shown on the definitive delivery bill and on the invoice. In the event that a product is listed on the final delivery bill and the invoice but was not actually delivered, the customer will be refunded the corresponding amount.
The customer shall not be entitled to any claim for compensation or damages for partial deliveries.
Delivery charges
The delivery charges are shown when the order is placed. The amount of the delivery charges varies depending on the selected delivery method, the order value less any vouchers and discounts and the order frequency. A minimum order value may apply depending on the product range and delivery method.

Delivery bills and invoices are always sent electronically.
PRICES AND PAYMENT
Prices
All prices are in Swiss francs, including applicable VAT. The prices shown on the website of the online store at the time of the order are always decisive.
Payment methods and payment deadlines
Various payment methods are available for payment, whereby SANACUTE is entitled in each case to decide at its own discretion which means of payment it accepts in each specific individual case.
The various payment options are: Credit card, TWINT and invoice.
For legal entities, the payment method "on account" is only available following a written application (invoice application for companies or invoice application for public institutions and organizations). The payment methods that can be selected are displayed for selection when the order is placed during the order completion process.
If a customer is in arrears with the payment of previous invoice amounts at the time of the order or if the personal credit limit has been exceeded, the "on account" payment method is not available.
Invoices are sent electronically after delivery if possible, otherwise by post to the master address specified by the customer or enclosed directly with the delivery. Invoices must be paid within 30 days of receipt without deductions or other discounts. Unauthorized deductions will be charged subsequently. An administration fee of CHF 2.90 will be charged per invoice if sent by post. Dispatch by e-mail is free of charge.
Credit check / creditworthiness
SANACUTE is entitled to make the delivery of orders dependent on a credit check.
By placing an order, the customer expressly authorizes SANACUTE to carry out credit checks at its own discretion and, if necessary, to pass on customer data to third parties for this purpose.
Debt collection and assignment of claims to third parties
SANACUTE is entitled to commission third parties with the collection of outstanding payments and to assign the claim to third parties in Switzerland and abroad.
Discounts, benefits and vouchers
Promotions
The promotions offered in the online store do not necessarily correspond to those of other sales channels.
Vouchers
In the SANACUTE online store, only vouchers on which the online store is expressly mentioned as the place of redemption will be accepted. Only one voucher can be redeemed per order. An accumulation of vouchers is not possible. Vouchers must be entered directly when the order is placed; it is not possible to have them credited later. If the purchase value of the order is lower than the amount of the voucher, the remaining amount will be forfeited.
DATA PROCESSING AND DATA PROTECTION
So that we can constantly improve our offers within SANACUTE and point you to suitable products and offers, we evaluate your purchasing and online behavior data, provided you have a customer account with us, and use these within SANACUTE in accordance with the following principles. Further information on data processing can also be found in our privacy policy.
By accepting these GTC, you agree that your personal data, such as name, address or e-mail address, together with the purchase data and online behavior data, may be collected and evaluated for marketing and advertising purposes within SANACUTE. This data may be enriched with other data collected about you by us or partner companies of SANACUTE (e.g. during purchases). This enrichment may include personal master data, contact data, financial data, purchase data, transaction data, online recognition, location and traffic data or specific evaluations. Based on this data, target groups can be formed consisting of customers with similar and comparable interests and purchasing data. This is done using mathematical-statistical methods that are generally recognized. Based on the evaluations, we can send you personalized and relevant information about products or offers (e.g. by e-mail or post) or display personalized recommendations on our website. If you do not wish your data from this online store to be used for marketing purposes within SANACUTE, you can adjust the settings in your customer account accordingly.
You agree that we may grant cooperation and advertising contract partners (contractual partners) access to certain aggregated data (e.g. preferences) based on an identification number or e-mail address in pseudonymized form (so-called hashing) for the purpose of placing personalized advertising. By matching the data, the contractual partner recognizes the data that already exists in its database. This allows the contractual partner to place target group-based advertising for itself or third parties and to carry out the corresponding non-personal evaluations in its area (e.g. on the number of customers who have viewed the advertising). The contractual partner will not identify you personally or use the data for other purposes. Contact form
Defects must be reported immediately upon receipt of the goods. Otherwise the goods shall be deemed to have been accepted by the customer as faultless. Hidden defects must be reported to customer service as soon as they are discovered.
If the complaint is justified, the purchase price will be refunded to the customer. The customer keeps the product. The method of refunding the purchase price depends on the chosen means of payment. This is the case if a refund with the selected means of payment or a chargeback to the selected means of payment is not possible.
FINAL PROVISIONS
Contradictions between the languages
In the event of any ambiguities and/or contradictions between the German, French, Italian and/or English texts, only the German text shall prevail.
Amendment of the GTC
SANACUTE reserves the right to amend these GTC at any time. The changes will be announced on the website of the online store and come into force when they are activated. The customer accepts the new provisions with the first order after the new GTC have been activated.
Severability clause
If parts of these GTC prove to be unenforceable or invalid, this shall not affect the validity of the remaining provisions.
Applicable law and place of jurisdiction
Swiss law shall apply exclusively. The place of jurisdiction for natural persons and legal entities is exclusively Zug.
